The overwhelming majority of civil lawsuits are settled before trial, and the percentage of those settled through some form of ADR, such as mediation, is steadily increasing.

Although ADR is not trial, it is an adversarial process and, like trial, preparation and presentation are critical to success. Most experienced lawyers and mediators know that one side typically walks away a “winner”.
